Welcome to Guam Time Group (GuamTime). This page explains the terms by which you may use our website, mobile website and software provided on or in connection with the service. By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Service Agreement (“Agreement”) and to the collection and use of your information as set forth in the Guam Time Group Privacy Policy, whether or not you are a registered user of our Service. This Agreement applies to all visitors, users, and others who access the Service (“Users”).

 

PLEASE READ THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION OF DISPUTES PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.

User Terms of Service

 

1.SALE OF TICKETS

1.1 Please examine your tickets carefully upon receipt as mistakes cannot be rectified, tickets exchanged or monies refunded at a later date.

 

1.2 Tickets you purchase are for personal use. Tickets must not be resold at a higher price than face value. Guam Time Group has the right to cancel tickets that have been resold at a higher price without prior notification and the holder may be refused entry.

 

1.3 Guam Time Group reserves the right to introduce discounts and special offers at any time, and these cannot be applied to tickets already purchased. Only one discount can apply to any one ticket.

 

1.4 Guam Time Group will not take tickets back for resale. We cannot resell any tickets purchased through a ticket agent or another ticket platform.

 

2. CANCELLED/RESCHEDULED EVENTS/CHANGES TO PERFORMANCES

2.1 As the ticket provider, GuamTime Group is not responsible for any events that have been changed, rescheduled, or cancelled. 

 

2.2 It is your responsibility to ascertain whether an event has been cancelled or rescheduled and the date and time of any rescheduled event. Where an event is cancelled or rescheduled, we will use our reasonable endeavors to notify you using the details you provided us with at the time of ordering. We do not guarantee that you will be informed of such cancellation before the date of the event.

 

2.3 It is your responsibility to inform us of any change to the contact address, telephone number or email address you provide us with at the time of ordering.

 

2.4 The event organizer reserves the right to change details surrounding their event due to unforeseen circumstances. All ticket holders will be notified of any changes, if practicably possible.

 

2.5 The event organizer reserves the right to change the start and finish times of any performance.

 

2.6 Artists, schedule, and performance details are correct at the time of sale or print publication, but changes may be unavoidable.

 

3. REFUNDS/EXCHANGES

3.1 You are responsible for reading the complete listing before making a commitment to buy tickets. When placing an order, you are entering into a binding contract with the Seller to purchase those tickets. Payment is remitted to Guam Time Group and disbursed to the seller according to our payment policy.

 

3.2 Guam Time Group does not issue refunds as all sales are final. You cannot change or cancel any orders after the sale is complete.

 

3.3 Guam Time Group is solely the ticket provider and is not responsible for location, performer, or time changes to an event. Performers are subject to change without notice. No refunds will be processed for changes to an event. Any inquiries on refunds must be communicated to the event organizer directly. 
 

4. ADMISSION

4.1 Event organizers reserve the right to refuse admission, and to request any ticket holder to leave their venue at any time. For example, if a ticket holder appears to be under the influence of drink and/or drugs and/or is acting aggressively, carrying offensive weapons or illegal substances, the ticket holder may be refused admission. Guam Time Group will not be held responsible for any refusal of entry

 

4.2 Event organizers reserve the right to refuse re-admission to any person not in possession of a ticket or the retained portion of the ticket.

 

4.3 Latecomers may be admitted at a suitable point in the performance at the discretion of the management.

 

4.4 Patrons must not obstruct any stairway or gangway within a venue and must not affect the enjoyment of the audience and/or the running of the venue/concert and/or cause a risk to the safety of the audience or officials.

 

5. LIABILITY

5.1 Personal arrangements including travel, accommodation or hospitality relating to the event which have been arranged by you are at your own risk. Unless otherwise stated in this clause, our and the venue’s liability to you in connection with the event (including, but not limited to, in the event of cancellation, rescheduling or material change to the programme of the event) shall be limited to the ticket price paid by you including the per ticket booking fee.

 

5.2 Neither we nor the event organizers will be responsible for any loss, injury or damage to any person (including you) or property howsoever caused (including by us and/or by event partner(s)): (a) in any circumstances where there is no breach of a legal duty of care owed by us or the venue); (b)in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from our negligence); or (c) to the extent that any increase in any loss or damage results from breach by you of any of these Terms and Conditions and/or any terms and conditions of the event partner(s).

 

5.3 Nothing in these Terms and Conditions seeks to exclude or limit our or the event partner(s)’ liability for death or personal injury caused by our or the event partner(s)’ (as relevant) negligence, fraud or other type of liability which cannot by law be excluded or limited.

 

6.GENERAL

6.1 Guam Time Group or its agents may carry out film or sound recording in or around the various event venues. By purchasing tickets you consent to you and your party being included in any recording, and to its exploitation, without payment.

 

6.2 Guam Time Group acts as a box office for external events. Although we assist with promoting the event, Guam Time Group are not the event organizers and take no responsibility for any aspect of their programme or operation. Any queries should be directed to the promoter concerned.

 

7. DATA PROTECTION

7.1 Once you have booked tickets with Guam Time Group your name and address will be held and processed on our box office and marketing databases. From time to time, we will send you information about similar concerts and activities using the information you have provided. If you do not wish to receive any further information you should unsubscribe from any emails where indicated or alternatively contact Guam Time Group at info@guamtime.net

 

8. Privacy

We care about the privacy of our Users. You understand that by using the Services you consent to the collection, use and disclosure of your personally identifiable information and aggregate data as set forth in our Privacy Policy, and to have your personally identifiable information collected, used, transferred to and processed in the United States.

 

9. Security

Guam Time Group uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information and implement your privacy settings. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.

 

10. No Warranty

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, GUAM TIME GROUP, ITS SUBSIDIARIES, ITS AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT THE CONTENT IS ACCURATE, RELIABLE OR CORRECT; THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DOWNLOADED AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR YOUR USE OF THE SERVICE.

 

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THE DISCLAIMERS AND EXCLUSIONS UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

 

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUAM TIME GROUP, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE. UNDER NO CIRCUMSTANCES WILL GUAM TIME GROUP BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GUAM TIME GROUP  ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL GUAM TIME GROUP, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO GUAM TIME GROUP HEREUNDER OR $100.00, WHICHEVER IS GREATER.

 

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF GUAM TIME GROUP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

 

THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM COUNTRY TO COUNTRY. THE EXCLUSIONS AND LIMITATIONS OF LIABILITY UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

 

The Service is controlled and operated from facilities in Guam, a territory of the United States. Guam Time Group makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable Guam/United States and local laws and regulations, including but not limited to export and import regulations. You may not use the Service if you are a resident of a country embargoed by the United States, or are a foreign person or entity blocked or denied by the United States government.

Merchant Terms of Service

 

1.Use of Our Service

GuamTime provides a place for you to discover and buy event tickets through our online platforms. We also provide information for local venues, floor maps, and other event related data.

 

1.1 Eligibility

The online platform is eligible to everyone. However, in order to utilize ticketing service, you must have a binding contract with Guam Time Group, and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Any use or access to the Service by anyone under 13 is strictly prohibited and in violation of this Agreement. The Service is not available to any Users previously removed from the Service by Guam Time Group.

 

1.2 Guam Time Group Service

Subject to the terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service for your personal, noncommercial use only and as permitted by the features of the Service. Guam Time Group reserves all rights not expressly granted herein in the Service and the Guam Time Group Content (as defined below). Guam Time Group may terminate this license at any time for any reason or no reason.

 

1.3 Guam Time Group Accounts

Your Guam Time Group account gives you access to the services and functionality that we may establish and maintain from time to time and at our sole discretion. We may maintain different types of accounts for different types of Users. If you open a Guam Time Group account on behalf of a company, organization, or other entity, then (a) “you” includes you and that entity, and (b) you represent and warrant that you are an authorized representative of the entity with the authority to bind the entity to this Agreement, and that you agree to this Agreement on the entity’s behalf. By connecting to Guam Time Group with a third-party service, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials for that service.

 

You may never use another User’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. You must notify Guam Time Group immediately of any breach of security or unauthorized use of your account. Guam Time Group  will not be liable for any losses caused by any unauthorized use of your account.

 

By providing Guam Time Group your email address you consent to using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Service and special offers. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

 

1.4 Service Rules

You agree not to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated “scraping”; (ii) using any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Service in a manner that sends more request messages to the Guam Time Group servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser; (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service; (v) uploading invalid data, viruses, worms, or other software agents through the Service; (vi) collecting or harvesting any personally identifiable information, including account names, from the Service; (vii) using the Service for any commercial solicitation purposes; (viii) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity; (ix) interfering with the proper working of the Service; (xi) accessing any content on the Service through any technology or means other than those provided or authorized by the Service; or (x) bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.

We may, without prior notice, change the Service; stop providing the Service or features of the Service, to you or to users generally; or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason, including if in our sole determination you violate any provision of this Agreement, or for no reason. Upon termination for any reason or no reason, you continue to be bound by this Agreement.

You are solely responsible for your interactions with other Guam Time Group Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users. Guam Time Group shall have no liability for your interactions with other Users, or for any User’s action or inaction.
 

2. User Content License Grant

2.1 By posting any User Content on the Service, you expressly grant, and you represent and warrant that you have all rights necessary to grant, to Guam Time Group a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, syndicate, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Service and Guam Time Group (and its successors’ and affiliates’) business, including without limitation for providing, promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each User of the Service a non-exclusive license to access your User Content through the Service, and to use, reproduce, distribute, display and perform such User Content as permitted through the functionality of the Service and under this Agreement.

 

3. Our Proprietary Rights

3.1 Except for your User Content, the Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and User Content belonging to other Users (the “Guam Time Group Content”), and all Intellectual Property Rights related thereto, are the exclusive property of Guam TIme Group and its licensors (including other Users who post User Content to the Service). Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any Guam Time Group Content. Use of the Guam Time Group Content for any purpose not expressly permitted by this Agreement is strictly prohibited.
 

4. Paid Services

4.1 Billing Policies

Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms, as we may update them from time to time. Guam Time Group may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. We do not offer any recurring paid services, nor do we charge a recurring subscription fee for using our website. Any change to our pricing or payment terms shall become effective in the billing cycle following notice of such change to you as provided in this Agreement.

4.2. Final Sale

You may cancel your Guam Time Group account at any time; however, there are no refunds for cancellation. In the event that Guam Time Group suspends or terminates your account or this Agreement for your breach of this Agreement or for any reason, you understand and agree that you shall not receive a refund, exchange, or anything at all, any content or data associated with your account, or for anything else to the maximum extent permitted by applicable law.

Guam Time Group is not responsible for location, performer, or time changes to an event. Performers are subject to change without notice. No refunds will be processed for changes to an event.

 

5. Vendor and Supplier Payments

5.1 Unless otherwise agreed by the parties in writing and subject to the terms hereof, Guam Time Group shall remit payments due to you hereunder no later than forty eight (48) hours upon completion of the event. Payment shall be in the form of check or PayPal. If payments are made via PayPal, the merchant agrees to incur the goods and services fees, plus any additional international fees and taxes. 

 

5.2 Guam Time Group reserves the right to withhold payment or charge back to your account any amounts otherwise due to us under these Additional Terms, or amounts due to any breach of the Terms by you, pending Guam Time Group’s reasonable investigation of such breach.

 

5.3 To ensure proper payment, you are solely responsible for providing and maintaining accurate contact and payment information associated with your account, which includes without limitation applicable tax information. If we believe that we are obligated to obtain tax information and you do not provide this information to us after we have requested it, we may withhold your payments until you provide this information or otherwise satisfy us that you are not a person or entity from whom we are required to obtain tax information. 

 

5.4 Any third-party fees related to returned or cancelled payments due to a contact or payment information error or omission may be deducted from the newly issued payment. You agree to pay all applicable taxes or charges imposed by any government entity in connection with your participation in the Program. If you dispute any payment made hereunder, you must notify Guam Time Group in writing within thirty (30) days of the earlier of: (i) receipt of such payment; or (ii) when such payment would have been due to you hereunder. Failure to so notify Guam Time Group shall result in the waiver by you of any claim relating to such disputed payment.

 

5.5 Payment shall be calculated solely based on records maintained by Guam Time Group. No other measurements or statistics of any kind shall be accepted by Guam Time Group or have any effect under these Additional Terms. We may withhold any taxes or other amounts from payments due to you as required by law. 

 

6. Third-Party Links

6.1 The Service may contain links to third-party websites, services, special offers, or other events or activities that are not owned or controlled by Guam Time Group. Guam Time Group does not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third party website from the Service, you do so at your own risk, and you understand that this Agreement and Guam Time Group’s Privacy Policy do not apply to your use of such sites. You expressly relieve Guam Time Group from any and all liability arising from your use of any third-party website, service, or content.

 

7. Indemnity

7.1 You agree to defend, indemnify and hold harmless Guam Time Group and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising out of or related to: (i) your use of and access to the Service, including any data or content transmitted or received by you; (ii) your violation of any term of this Agreement, including without limitation your breach of any of the representations and warranties above; (iii) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; (iv) your violation of any applicable law, rule or regulation; (v) User Content or any other information or content that is submitted via your account including without limitation misleading, false or inaccurate information; (vi) negligent or willful misconduct; or (vii) any other party’s access and use of the Service with your unique username, password or other appropriate security code.
